- The compliance of arrangements made with Nauru and Papua New Guinea to process and resettle asylum seekers with Australia's obligations pursuant to the Convention Relating to the Status of Refugees 1951. This request was limited to the period July 2012 - July 2013. The request was refused, as there were 2500 documents located comprising 32,000 pages that would be relevant.
- Advice provided to government on the compliance of asylum seeker policy with international human rights law, namely the 'No Advantage' principle, and the Pacific Solution. This advice was refused, as there were 3500 documents comprising over 50,000 pages that would be relevant.
Both of these requests were refused as compliance would "constitute an unreasonable diversion of the Department's resources."
We would ask whether there has already been an unreasonable diversion of departmental resources, given the scale of advice required by government on this issue.
